Terms and Conditions

The German version is the binding one. This English text is a convenience translation of the German Terms and Conditions at zquady.com/agb. It is provided to make the content easier to understand. In the event of any discrepancy between the two versions, the German wording prevails — see section 1 below.
1. Scope and provider
These Terms apply to the use of the Zquady app and the associated websites (zquady.com, app.zquady.com).
The provider and your contracting party is:

The full provider details are set out in the Legal Notice. By registering you agree to these Terms. Users' own or deviating terms do not apply.
The app is available in German, English, French, Spanish, Italian and Chinese. Only the German version of these Terms is binding; translations are provided solely to make the content easier to understand.
2. Who may use Zquady
- You must be at least 18 years old. Zquady brings together people who meet in real life — there is no exception to this.
- You state your date of birth when registering. That is your own declaration. We do not check identity documents and do not use any external age verification service. A false statement is a breach of these Terms.
- One account per person is intended. We do not verify this technically. «Soll ein Verstoß dagegen Folgen haben? Wenn ja, welche — hier festlegen.»
- Your details must be truthful. Do not pretend to be someone else and do not create accounts for other people.
- You use Zquady personally and on your own behalf, not on behalf of or in the name of third parties.
3. What Zquady is — and what it is not
Zquady is a platform. Users post meet-ups here (“Zquads”) and others join them. That is all we do.
So, plainly and without small print:
- We do not organise these meet-ups. The organiser is always the person who created the Zquad (the host).
- We are not involved in any meet-up, we are not there in person and we are not a party to the arrangement. Joining is an arrangement between users.
- We do not vet anyone: no identity check, no background check, no proof of age beyond self-declaration. A Zquady account says nothing about who a person really is.
- We do not review content in advance. Zquads, profiles and messages appear without any check by us. We only act once something is reported to us or we otherwise become aware of it.
- The 👍/👎 ratings of a host are the opinions of other users. They are not a vetting process and not a safety guarantee.
- Whether a Zquad takes place, how it goes and who shows up is not within our control.
You meet people you do not know at your own responsibility. Please look after yourself: meet in a public place the first time, tell someone where you are and who you are with, and leave at any time if something feels off. If you are in danger, contact the police — we are not an emergency service and cannot intervene.
4. Your account
- Usernames are suggested by the app and you pick one of them. Free text entry is not provided. You can change your username at most once every 30 days.
- Keep your login credentials secret and do not pass them on. You can additionally enable two-factor authentication (2FA) — that is an option, not an obligation.
- You are responsible for everything that happens through your account. If you suspect that someone else has access, contact us immediately at support@zquady.com and change your password.
- You can also sign in with Apple, Google or Discord. All three sign-in options are enabled; in that case the terms of the respective provider apply in addition.
- For security reasons some changes are rate-limited: email address and password at most once every 24 hours, username once every 30 days. After several failed attempts at security-relevant actions, the action is temporarily blocked.
5. Zquads: creating, joining, cancelling
- Whoever creates a Zquad is the host. The host decides on join requests, can invite specific people, can remove individual members from the Zquad, and can cancel, reschedule or delete the Zquad.
- A Zquad can have a limited number of places. If it is full, you can put yourself on the waiting list and will be notified as soon as a place becomes free.
- Joining is an arrangement between users. There is no entitlement to a Zquad taking place, to a request being accepted or to anyone showing up.
- If a host states costs (e.g. admission or material costs), the participants settle that among themselves. Zquady does not process any payments and is not involved in them.
- After a meet-up, members can rate the host with 👍 or 👎. Ratings must reflect your own honest experience. Revenge ratings, coordinated ratings, bought or extorted ratings are prohibited.
- If a host deletes their account, the Zquads they created disappear, together with the group chat and the memberships of the other participants.

6. Rules of conduct
What is prohibited offline is prohibited on Zquady too. In addition, the following in particular are not allowed:
- harassment, threats, intimidation, stalking and anything intended to wear someone down;
- hate and denigration based on origin, skin colour, religion, disability, gender, sexual orientation, age or similar characteristics;
- incitement to violence, glorification of violence, extremist content and anything that is a criminal offence;
- sexual harassment, sexual content without consent, soliciting sexual services for payment;
- fake profiles, pretending to be someone else and acting in the name of others;
- advertising, spam, chain messages, pyramid schemes, poaching users, and commercial use «Umfang festlegen — siehe Abschnitt 5»;
- passing on other people's personal data without their consent: chat histories, screenshots, photos, addresses, phone numbers;
- content you have no rights to (other people's photos, music, texts, trade marks);
- trading in goods or services whose trade is prohibited or restricted;
- technical abuse: malware, automated extraction (scraping), bots, attempts to overload the service, circumventing security or blocking measures, accessing other people's accounts.

7. Your content
What you create belongs to you. We claim no ownership of your Zquads, texts, messages or photos.
For the app to work at all, we need one narrowly limited permission: you grant us the non-exclusive, royalty-free right to store your content, process it technically (e.g. resize images), transmit it and display it to exactly those people it is intended for. Nothing beyond that. We do not sell your content and do not use it for advertising.
You are responsible for your content and you warrant that you hold the necessary rights to it and that it infringes nobody's rights.
What you show in a group chat or on your profile is seen by other people — and they can copy it or photograph it. We cannot prevent that. So think carefully about what you share.
If you delete a piece of content or your account, our permission ends. The following are excepted:
- abuse reports, which are retained for safety reasons (the identifier of the reporting person is removed, the label of the reported content remains),
- technical error reports (in anonymised form),
- an uploaded profile photo and the counter of our email dispatch, which currently survive account deletion,
- «Sicherungskopien / Backups: Aufbewahrungsdauer beim Backend-Anbieter prüfen und hier eintragen».

8. Reporting and blocking
In the app you can report profiles, individual Zquads and individual messages. The available reasons are spam, inappropriate content, harassment and — for profiles — fake profile. Your report goes directly to us; the reported person does not learn who reported them.
You can also block people. Anyone who is blocked can no longer message you and disappears from your message list. You can view your block list at any time and unblock people again.
Your privacy settings additionally determine who may message you and who can see your profile picture and your bio.
We deal with reports without undue delay, as a rule within 72 hours. Our single point of contact under the Digital Services Act, for users and authorities alike, is support@zquady.com; it is also stated in the Legal Notice. You can appeal against a measure in accordance with section 9.

In case of imminent danger, a criminal offence or an emergency, please contact the police or the emergency services first «Notrufnummern des Sitzstaats eintragen». We cannot intervene and are not an emergency service.
9. Measures in the event of breaches
If you breach these Terms or applicable law, we may — graded according to severity — remove content, warn you, restrict individual functions, suspend your account or delete it. In doing so we choose the mildest means that is sufficient.
We will tell you that we have taken action and why «Ausnahmen festlegen, z. B. bei Strafverfolgung oder offensichtlichem Missbrauch».
Appeal: you can appeal against any measure. To do so, write to us at support@zquady.com. «Frist für den Einspruch und für unsere Antwort festlegen — der DSA verlangt ein internes Beschwerdeverfahren.»
«VOR DER VERÖFFENTLICHUNG ENTSCHEIDEN: In der App gibt es derzeit keinen Sperr- oder Bann-Mechanismus für Konten — Meldungen haben nur einen Bearbeitungsstatus. Eine Sperre wäre aktuell nur manuell über die Datenbank möglich. Entweder einen Sperrstatus einbauen oder diesen Abschnitt auf das beschränken, was tatsächlich geht (Inhalte entfernen, verwarnen, Konto löschen). Dieser Kasten gehört danach gestrichen — in beiden Sprachfassungen.»
10. Availability and changes to the service
We do our best to keep Zquady running reliably. However, we do not owe uninterrupted operation. Maintenance, faults and outages can occur, including at services we depend on.
We may keep developing the app: functions may be added, changed or removed. We will announce material changes or a discontinuation of the service in advance «Ankündigungsweg und Frist festlegen».
There is no entitlement to the continued existence of individual functions.
11. Costs
Zquady is currently free of charge. There are no paid functions in the app, no subscriptions and no payment processing.

12. Term, termination and account deletion
- The user agreement runs for an indefinite period and begins with registration.
- You can delete your account at any time and without giving reasons in the app (Profile → Account → Delete account).
- Deletion takes effect immediately and cannot be undone. There is no grace period, no recycle bin and no restore.
- Deleted along with it are: the Zquads you created — including the group chat and the memberships of all other participants — as well as your messages, including those in other people's group chats and in your chat partners' direct messages.
- Linked sign-ins via Apple, Google or Discord are deleted as well. Your email address is immediately available again for a new registration afterwards.
- Some things survive deletion — abuse reports, technical error reports and, at present, an uploaded profile photo as well. Section 5.2 of the Privacy Policy lists them in full.
- We may terminate the agreement by ordinary notice with a notice period of «Frist festlegen». In the case of serious or repeated breaches we may terminate without notice and delete the account.
13. Liability
«Dieser Abschnitt muss von einem Anwalt oder einer Anwältin formuliert werden. Wir liefern hier nur die Struktur — bei Haftungsklauseln entscheidet die Formulierung darüber, ob sie hält, und eine unwirksame Klausel kann den gesamten Abschnitt zu Fall bringen. Nichts hiervon ist eine fertige Klausel.»
At a minimum, the following must be addressed:
- Liability for intent and gross negligence as well as for personal injury — cannot be excluded by law.
- Extent of liability for slight negligence «festlegen».
- The central point for this app: the conduct of other users and everything that happens at a meet-up — injuries, damage, criminal offences, arrangements that fall through. Zquady is not the organiser and does not vet anyone «Formulierung durch Anwalt, das ist der wichtigste Punkt».
- Content posted by users: hosting provider liability privilege under sections 13 et seq. ECG and Art. 6 DSA respectively «prüfen».
- External links, map services and other third-party services.
- Data loss, downtime, lost messages «festlegen».
- Mandatory consumer rights and the Product Liability Act remain unaffected.
14. Changes to these Terms
We may change these Terms, for example when the app, the legal situation or our service providers change.

If you do not agree with a change, you can delete your account at any time.
15. Applicable law, jurisdiction, dispute resolution
«Anwendbares Recht festlegen — z. B. das Recht des Sitzstaats unter Ausschluss der Verweisungsnormen und des UN-Kaufrechts.»
«Gerichtsstand festlegen. Achtung: Gegenüber Verbraucherinnen und Verbrauchern gelten zwingende Gerichtsstände, die nicht abbedungen werden können — anwaltlich prüfen.»
Consumer arbitration: we are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body. The same statement appears in the Legal Notice, section “Online dispute resolution and consumer arbitration”.
